WAIVER

Release to The Escape Guild LLC, DBA Hatch Escapes (the Releasee) of 2706 S. Normandie Avenue, Los Angeles, CA 90007 and 1919 3rd Avenue, LA, CA 90018.

I, the Releasor, being of lawful age, in consideration of being permitted to participate in a real life escape room game, provided by The Escape Guild LLC, DBA Hatch Escapes and Twin Alchemy LLC, and run and/or operated by the Releasee, WAIVE, RELEASE, and DISCHARGE the Releasee, its owners, officers, directors, employees, members, agents, assigns, legal representatives and successors, and all business associates and partners involved in the presentation of the above noted activity and each of them their owners, officers and employees, from all liability for or by reason of any damage, loss or injury to person and property, even injury resulting in the death of the Releasor, which has been or may be sustained in consequence of the Releasor’s participation in the activity described above, and notwithstanding that such damage, loss or injury may have been caused solely or partly by the negligence of the Releasor.

I agree to observe and obey the rules and warning, and further agree to follow any written and oral instructions or directions given by The Escape Guild LLC, DBA Hatch Escapes, their employees and agents.

I have been made aware of the circumstances of the escape room activity and if I am pregnant, claustrophobic, have a heart condition, have epilepsy, or any other significant health issue, or am sensitive, or believe that it may affect my health, I will not participate in the Event.

I agree to pay for all damages to the facilities of The Escape Guild LLC, DBA Hatch Escapes and Twin Alchemy LLC caused by my negligent, reckless, or willful actions.

I hereby acknowledge and agree that I have carefully read this Waiver and Release agreement, that I fully understand the same, and that I am freely and voluntarily executing same.

By signing this release, I will be forever prevented from suing or otherwise claiming against the Releasee for any property loss or property injury that I may sustain while participating in or preparing for the above noted activity.

I understand that I would not be permitted to participate in the above noted activity unless I have read this in its entirety and signed this Waiver and Release agreement.

I understand this Waiver and Release agreement is binding on me, my spouse, my heirs, my executors, administrators, personal representatives and assigns.

I acknowledge that I do not have any physical limitations, medical ailments, physical or mental disabilities that would limit or prevent me from participating in the above-mentioned activity, and, if required, will obtain a medical examination and clearance.

This release contains the entire agreement between the parties to this release and the terms of this release are contractual and not a mere recital.

This Waiver and Release Agreement will be construed in accordance with and governed by the laws of the State of California, and it is acknowledged by All parties to be as broad and inclusive as permitted by the laws of this jurisdiction.

I HAVE READ AND UNDERSTAND THIS AGREEMENT, AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINSTRATORS AND ASSIGNS MAY HAVE AGAINST THE RELEASEE.

USE OF PERSONAL INFORMATION

I authorize The Escape Guild LLC, DBA Hatch Escapes to use the following personal information: my Picture (including photographic, motion and electronic images) to publish on the internet and social networks. This permission extends to all languages, media formats, and markets not known or unknown and is continuous unless revoked in writing by me.

CONFIDENTIALITY

I acknowledge that during the course of the above noted activity I will be privy to certain information that must be maintained confidential in order to ensure the continued success of The Escape Guild LLC, DBA Hatch Escapes. The disclosure of any such information to the public, including through digital mediums and social media would result in irreparable harm to The Escape Guild LLC, DBA Hatch Escapes. I agree that any and all information obtained concerning the operation of the Event must be kept confidential.
